Tightening of the "Lex Koller" under review

As part of these accompanying measures, the Federal Department of Justice and Police (FDJP) is to submit a consultation draft to the Federal Council by the end of June 2025, which will examine a tightening of the "Lex Koller". This will include the following (new) restrictions for persons abroad/foreign investors:
Introduction of stricter rules for the acquisition of permanent establishment properties: Prohibition on letting, i.e. such properties may only be acquired by foreigners for their own use.
Stricter rules for the acquisition of shares in residential property companies listed on a Swiss stock exchange: Prohibition/authorisation requirement for the purchase of such shares by foreigners.
Introduction of stricter rules for the acquisition of main residences by nationals of non-EU/ EFTA states: Obligation to resell principal residences for persons abroad who give up their place of residence.
Restrictions on the purchase of holiday flats and residential units in apartment hotels by persons abroad.
